Welcome to WattHacker. WattHacker is a service operated by Tony Willcox, a sole proprietor located in California. These Terms of Service ("Terms") are a binding agreement between you and WattHacker ("WattHacker", "we", "us", or "our") governing your use of our websites, applications, monitoring hardware, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
WattHacker helps homeowners monitor the performance of their solar energy systems — including per-panel production, system health, and alerts. WattHacker is an independent product and is not affiliated with, endorsed by, or sponsored by SunPower, Maxeon, or any equipment manufacturer. We provide information and estimates to help you understand your system; we do not install, repair, or guarantee the operation of your solar equipment.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for activity under your account, and for keeping your login credentials secure. Notify us promptly of any unauthorized use.
Some features rely on a hardware device that connects to your solar gateway and your home network. You agree to use the device as intended, to maintain a working internet connection for it, and not to tamper with, reverse-engineer, or resell it except as permitted. The Service depends on data from your equipment and network; interruptions to either may affect availability and accuracy.
Certain features require a paid subscription. Paid plans are billed in advance on a recurring basis through our payment processor (Stripe) and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and access continues until then. Subscription fees already incurred are non-refundable except where required by law or expressly stated. We may change prices or plan features with reasonable notice.
A Lifetime plan is a one-time payment for access to premium features for as long as WattHacker continues to provide the Service. It is not a guarantee that the Service will be provided for any particular period and does not obligate us to continue operating. "Lifetime" refers to the lifetime of the Service — not to the lifetime of any person, property, or equipment. If we discontinue the Service, we will give you reasonable advance notice and the ability to export your data (Sections 10 and 16).
A Lifetime plan lasts for the lifetime of your account. It is tied to a single account and one monitor, and is not transferable — it cannot be sold, assigned, or passed to another person, another account, or a subsequent owner of your home or solar system. It ends if the account is closed. Lifetime plans are non-refundable after the 30-day period described in Section 6.
We want this to work for you. If you're not satisfied within 30 days of delivery — for any reason, including that it turns out not to be compatible with your system — we will refund what you paid. That covers the monitor, any shipping you paid, any subscription amount paid at checkout, and an energy review, whether or not the call has already happened. Start the return within those 30 days; the monitor does not have to be back with us by then.
The monitor comes back either way. This applies even where the monitor was included at no charge — for example with an energy review. In that case the hardware remains ours unless the order is kept, so a refund still requires its return, at your cost. If a monitor is not returned within a reasonable period after a refund is requested, we may decline the refund or charge for the unreturned hardware at its list price.
Refunding your order also ends any subscription that was part of it. Requests made more than 30 days after delivery are handled under Section 7 (Limited Hardware Warranty) rather than this guarantee.
We warrant to the original purchaser that the WattHacker monitor will be free from defects in materials and workmanship, under normal use for its intended purpose, for five (5) years from the date of delivery. For accounts on a Lifetime plan, this warranty continues for as long as we provide the Service (Section 5).
Remedy. If the monitor is defective during the warranty period, we will, at our option, replace it or refund the amount you paid for it. We pay outbound shipping on a warranty replacement, and return of the defective unit is not required. Replacement or refund is your sole and exclusive remedy under this warranty. A replacement unit is warranted for the remainder of the original warranty period, not a new five-year term.
Exclusions. This warranty does not cover: physical damage; liquid exposure; lightning, power surge, or electrical fault; fire; abnormal or unintended use; disassembly, modification, or repair not performed by us; loss or theft; cosmetic wear; or any failure caused by your network, power supply, or environment.
This warranty covers the WattHacker monitor only. We make no warranty regarding your solar panels, microinverters, gateway, meters, or electrical system, or their performance. This warranty runs to the original purchaser and is not transferable.
The Service reports data obtained from your solar gateway and is provided for informational purposes only. We do not guarantee that the Service will detect, identify, diagnose, or alert you to any particular fault, outage, underperformance, or defect in your solar system, gateway, panels, inverters, electrical system, or internet connection — whether or not such a condition is detectable from the available data.
The Service is not a substitute for inspection or maintenance by a qualified professional, and it is not an emergency-notification, safety, security, or fire-detection system. You remain solely responsible for the operation, maintenance, insurance, and safety of your solar system, and for your utility billing. Production figures, savings, earnings, and forecasts are estimates and may be inaccurate.
You agree not to:
Our handling of personal information is described in our Privacy Policy. You retain ownership of your data. You grant us a limited license to process it solely to provide and improve the Service.
Your data is yours to take. You can export your history at any time, on any plan, including the free plan. Note that free-plan accounts retain only the most recent 7 days of history — older readings are deleted and cannot be recovered — so an export from a free account covers that window. Paid plans retain full history.
The Service, including its software, design, and content, is owned by WattHacker and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial purposes. All rights not expressly granted are reserved.
The Service integrates third parties such as payment, hosting, email, mapping, and weather providers. Your use of those features may be subject to the providers' own terms, and we are not responsible for third-party services or content.
EXCEPT FOR THE LIMITED HARDWARE WARRANTY EXPRESSLY SET OUT IN SECTION 7, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT IMPLIED WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, THEY ARE LIMITED IN DURATION TO THE PERIOD OF THAT EXPRESS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
WattHacker is a monitoring and informational tool, not a safety, security, or emergency system, and not professional electrical, financial, or tax advice. We do not warrant that the Service will be uninterrupted, timely, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATTHACKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE, INCLUDING WITHOUT LIMITATION ANY LOST PROFITS OR DATA, LOST OR REDUCED SOLAR PRODUCTION, INCREASED OR UNEXPECTED UTILITY CHARGES OR TRUE-UP AMOUNTS, COSTS OF REPAIR OR INSPECTION OF YOUR SOLAR SYSTEM, PROPERTY DAMAGE, OR ANY FAILURE OF THE SERVICE TO DETECT OR REPORT A CONDITION.
OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID US — including what you paid for your monitor, shipping, and any subscription or Lifetime plan. We stand behind that amount: if we get it wrong, you can get back what you paid us. We are not able to accept liability beyond it.
You agree to indemnify and hold WattHacker harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
If we discontinue the Service — in whole or in part — we will give you reasonable advance notice and the ability to export your data before access ends. We do not guarantee that the Service will be available for any particular period. The monitor communicates with your solar gateway locally, but the app and stored history depend on our hosted service and will not remain available if the Service ends.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance. Changes do not apply retroactively to a completed purchase.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. The exclusive venue for disputes will be the state or federal courts located in California, unless applicable law provides otherwise.
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will stay in full force. Nothing in these Terms limits any right you have that cannot be limited or waived under applicable law.
